Do Relationship Property Rules Apply To De Facto Relationships?

 

I am in a de facto relationship, do relationship property rules apply to me?

Yes they do, if you’ve been with your partner for three years or more. The start of your “de facto” relationship is from the date you became a couple, not when you started living together.  Once you have been in a relationship with a person for 3 years, whether you are married or not then all property which isn’t ‘separate property’ under the Property (Relationships) Act 1976 becomes relationship property, and your partner is entitled to 50% of those assets. 

Relationship property includes things like pension schemes, furniture, insurances and any property you bought while in a relationship, or even property you owned before the relationship in some circumstances (for instance if you lived in the house together during your relationship).

Separate property includes property that you owned before the relationship, that hasn’t been used to ‘benefit’ both of you during the relationship (so you haven’t lived in it, or lived off the rental income together), inheritances are also separate property, and so is money in bank accounts in your sole name.
